La Ley Orgánica de Protección de Datos de Carácter Personal (LOPD) tiene el objetivo de garantizar y proteger todo aquello que concierne al tratamiento de los datos personales de las personas físicas. Por lo que se establecen una serie de obligaciones relativas a la recogida, almacenamiento, conservación y uso de aquellos datos que nos sirven para identificar a las personas físicas.
¿Quién debe cumplir con la Protección de Datos?
Están obligados a cumplir con la LOPD cualquier profesional o empresa pública o privada que tenga datos de carácter personal (nombre, apellidos, DNI, teléfono, email, formación, titulación, etc.) de clientes, socios, personal, etc.
¿Qué hay que hacer?
- Inscripción de los ficheros en la Agencia Española de Protección de Datos.
- Informar en la recogida de datos.
- Elaboración del Documento de Seguridad.
- Adoptar las medidas de seguridad acordes a la categoría de los datos que almacenemos.
- Elaboración de un Manual con las Funciones y Obligaciones del personal.
- Actualización e implantación de la LOPD en la web de la empresa a través del Aviso Legal y de la Política de Privacidad, así como de la Política de aviso de Cookies.
- Revisión anual.
¿Qué me puede pasar si no se cumple?
Las sanciones derivadas de su incumplimiento oscilan entre los 900 y los 600.000 euros, en función de si se trata de infracciones de tipo leve o muy grave.
